RULES
OF THE BEIJING CUSTOMS CONCERNIG THE SUPERVISIN AND CONTROL OF THE
IMPORT AND EXPORT OF MOTOR VEHICLES BY THE DIPLOMATIC MISSIONS AND
THEIR MEMBERS IN CHINA
Article
1 These Rules are formulated in accordance with the Regulations
of the General Administration of Customs of the People's Republic
of China on the Import and Export of Articles by the Diplomatic
Missions and Their Members in China.
Article 2 The Diplomatic Missions (hereinafter referred to as the
Missions ) or their members shall inform the Beijing Customs in
note before their import, export or transfer of motor vehicles for
official or private use and send a copy of the note to the protocol
Department of the Ministry of Foreign Affairs of China. The Missions
or their members concerned shall fill out in triplicate the Declaration
Form of Articles for Official or Private Use Imported or Exported
by the Diplomatic and Consular Missions (hereinafter referred to
as the "Declaration Form" ) or the Application Form for
the Transfer of Ownership of Articles for Official or Private Use
of the Diplomatic and Consular Missions (hereinafter referred to
as the "Application Form"). Each copy of the form shall
bear the seal of the mission concerned and the signature of the
diplomat of the mission which are both on record at the Beijing
Customs. While importing, Exporting or transferring ownership of
motor vehicles for private use, the members of the Missions concerned
shall submit to the Customs for examination their identity cards
issued by the Ministry of Foreign Affairs of the People's Republic
of China.
Article 3 The Beijing Customs shall complete the examination and
approval procedures within 10 working days (Excluding Sundays and
legal holidays. The same below.) upon the receipt of the written
application. With the examination and approval by the Customs, the
members of the Missions concerned shall go through the formalities
including delivery of vehicle, canceling or changing license plates,
or completing other procedures upon presentation of documents of
approval of the Beijing Customs.
Article 4 After obtaining permission to import motor vehicles for
official or private use, the Missions or their members shall, within
10working days of the delivery of the vehicles, carry the second
copy of the Declaration Form and drive the vehicles concerned to
the Beijing Customs or places designated by it. The Customs shall
issue the Notice for Obtaining License Plates for Imported Vehicles
(hereinafter referred to as Import Notice) after checking the vehicles
concerned. The members of the mission concerned shall obtain the
license plates at the Vehicle Control Division of the Beijing Public
Security Bureau (hereinafter referred to as the Vehicle Control
Division ) within 10 working days of obtaining the Import Notice.
Article 5 At the termination of the tenure of office, the members
of the Missions shall go through the re-export ( or transfer ) procedures
for their private vehicles prior to or simultaneously with the re-export
of their personal effects.
Article 6 For the re-export of motor vehicles by the Missions for
their members, the vehicles concerned shall be driven to the Beijing
Customs or places designated by it and, together with the Note issued
by the mission concerned on the re-export of vehicles, within a
guaranteed period and licenses of vehicles, submitted to the Customs
for examination and approval.
The Beijing Customs shall issue the Notice on Canceling License
Plates of Exported Vehicles (hereinafter referred to as Export Notice
) after approval. The members of the Missions concerned shall cancel
the license plates at the Vehicle Control Division within 10 working
days of receiving the Export Notice, return the Export Notice endorsed
by the Vehicle Control Division to the Beijing Customs and go through
the procedures for the re-export of vehicles. The Missions and their
members concerned shall still be responsible for the said motor
vehicles before their consignment for shipping.
Article 7 When Missions or their members transfer their motor vehicles,
the recipients shall only be other foreign agencies in China, non-residents
or signaled Chinese commercial departments ( in case of Beijing,
the purchase department of the Friendship Corporation ) that have
the right to import motor vehicles.
In accordance with the provisions of Article 27 of Regulations of
the General Administration of Customs of the People's Republic of
China on Supervision and Control of Luggage of Entry and Exit Passengers,
"non-residents" in this Article refers to persons who
return to their regular places of permanent residence outside China
after residing in China.
Article 8 Motor vehicles may be transferred only when they have
a period of usage over two years by the selling party while still
in service life of not having reached the stage to be scrapped as
prescribed by competent departments of the People's Republic of
China.
No motor vehicles of the Missions or their members for official
or private use that expire the service life or reach the stage to
be scrapped as prescribed by the competent departments of the People's
Republic of China are permitted to be transferred. But these vehicles
may be re-export or subject to disposal by the designated vehicle
disassembling factory under the supervision of the Customs.
Article 9 When the Missions or their members transfer motor vehicles
to other Missions or their members, or to other foreign agencies
in China or non-residents, the selling parties shall drive the motor
vehicles to Beijing Customs or places designated by Beijing Customs
and submit the vehicles, Application Forms, Drivers licenses and
other necessary documents to the Customs for examination and approval.
Upon obtaining the approval, the Missions or their members shall
complete the procedures of changing license plates of the vehicles
at the Vehicle Control Division within 10 working days of the approval
by the Customs. Prior to the completion of the procedures, the selling
parties shall still be responsible for their motor vehicles and
shall not be permitted to import new vehicles.
Article 10 For transfers of their motor vehicles to the purchase
department of the Friendship Corporation, the Missions or their
members may go to the said department with the Application Forms
to Negotiate the price.
Having decided to transfer their motor vehicle to the purchase department
of the Friendship Corporation, the Missions or their members shall
drive their vehicles to Beijing Customs or places designated by
Beijing Customs and submit them with two copies of the Application
Forms endorsed by the said department, purchase forms and drivers
license to the Customs for examination and approval. The Customs
shall issue and Export Notice upon approval. Members of the Missions
shall, within 10 working days of the receipt of the Export Notice,
complete procedures of canceling the license plates of the vehicles
at Vehicle Control Division and other Customs formalities.
Article 11 In case of the failure by the Missions or their members
to complete all procedures of applying for, canceling and altering
license plates of the vehicles of re-export the vehicles within
the time frame as provided by the present Rules, the Customs shall
postpone the examination and approval of the import and export of
other articles by the parties concerned.
Article 12 The import, export and transfer of motor vehicles for
official or private use by other foreign agencies or their members
in China who enjoy diplomatic privileges and immunities in accordance
with the Regulations of the People's Republic of China On Diplomatic
Privileges and Immunities shall be dealt with in reference to the
relevant provisions of the present Rules.
Article 13 The present Rules shall take effect as of 1 February
1991.
